Claims against tenders or decisions made by the Contracting Entity must be submitted to the Secretariat of the ICC International Court of Arbitration. By participating in the Tender Procedure, the applicants and tenderers undertook not to bring an action (or any other equivalent legal remedy): (a) to invalidate the Contract concluded as a result of this Tender Procedure, declare it null and void or otherwise ineffective, terminate it or suspend its performance, after the lapse of (i) 30 calendar days from the receipt of written notification about the conclusion of the Contract when the notification is accompanied by a justification for the decision; or (ii) 45 calendar days from the publication of a contract award notice in Tenders Electronic Daily by the Contracting Entity; or (iii) in any case before the expiry of a period of six months with effect from the day following the date of the conclusion of the Contract, whichever comes first; (b) to invalidate the Prequalification Notice, the future tender material including the Tender Conditions or any decision of the Contracting Entity made on its basis, declare it null and void or otherwise in-effective, terminate it or suspend its performance, after the lapse of 21 calendar days from the date of: (i) the receipt of this Prequalification Notice or later the tender material and/or the Tender Conditions; or (ii) the receipt of written information about the Contracting Entity's decision, when it is accompanied by a justification for the decision
